Welcome to PicForge! These Terms of Service ("Terms") govern your access to and use of the PicForge website, mobile applications, and services (collectively, the "Service"), provided by PicForge Inc. ("Company", "We", "Us", or "Our"). Please read these Terms carefully before using the Service. By accessing or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, do not use the Service.

1. Description of Service: PicForge provides an artificial intelligence (AI) powered platform that allows users to generate, modify, and optimize product designs, mockups, descriptions, and related commercial assets (collectively, "Generated Content") based on user-provided inputs, text prompts, images, or other data ("Inputs").

2. Eligibility and Account Registration: You must be at least 18 years old (or the age of majority in your jurisdiction) to use this Service. By creating an account, you represent and warrant that you have the legal capacity to enter into this agreement. To access certain features, you must register for an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

3. Inputs and Generated Content (AI Specifics): You retain all ownership rights to the text, images, or assets you upload to the Service ("Inputs"). You grant PicForge a worldwide, royalty-free, non-exclusive license to host, store, use, and process your Inputs solely to provide, maintain, and improve the Service. Subject to your compliance with these Terms and payment of any applicable fees, PicForge hereby assigns to you all its rights, title, and interest (if any) in and to the Generated Content. You are permitted to use the Generated Content for commercial purposes (e.g., selling products featuring the designs, marketing, e-commerce listings) unless stated otherwise in your specific subscription plan.

AI Nature Notice: You acknowledge that due to the nature of machine learning, Generated Content may not be unique, and the Service may generate the same or similar outputs for other users. PicForge makes no guarantees regarding the copyrightability or exclusive ownership of AI-generated assets under local laws.

5. Fees, Subscriptions, and Refunds: Certain features of the Service require a paid subscription or the purchase of credits. Current pricing and plan tiers are detailed on our platform. Subscriptions are billed on a recurring basis (monthly or annually) and will automatically renew unless canceled before the renewal date. Due to the severe computing costs associated with AI generation, all purchases and subscription renewals are generally non-refundable. Any exceptions are handled on a case-by-case basis at the sole discretion of PicForge.

6. Intellectual Property of PicForge: Except for your Inputs and Generated Content, the Service and all materials therein, including software, logos, trademarks, UI designs, graphics, and proprietary algorithms, are the exclusive property of PicForge Inc. and its licensors.

7. Termination: We reserve the right to suspend or terminate your access to the Service at any time, without notice, for conduct that we believe violates these Terms, is harmful to other users, or harms the business interests of PicForge. You may cancel your account at any time through your account settings.

10. Governing Law: These Terms shall be governed by and construed in accordance with the laws of the jurisdiction where PicForge Inc. is legally incorporated, without regard to its conflict of law principles.

11. Changes to Terms: We may update these Terms from time to time. If we make material changes, we will notify you by updating the "Last Updated" date at the top of this document or via an in-app/email notification. Your continued use of the Service after such changes constitutes acceptance of the new Terms.
